Apparently many American states are repealing simular laws because it has been realised stimgatising people` with Aids helps no one
Stigmatising people with aids definitely helps no one - however making it illegal to pass it on to other people, with out reasonable consideration for their welfare almost certainly does
How do we legislate for foolishness though? Some on here seem determined to say this girl went out with the intent to spread disease.The fact that the gbh charges and assault charges were found not guilty says the German court agrees.She was only convicted of failure to inform her partners.

Foolishness is fairly easy to legislate around - if you throw a brick at a window, expecting it to bounce back, but it smashes - then you've been foolish, but can still be done for criminal damage as a reasonable person would think it reckless to throw a brick at a window.
Sounds like the German laws are similar to ours in that you need intent for a charge of assault - so with my spitting example - you must be intending to spit in my face, not just spraying when talking !
