i suppose its to stop the fraudulent use of a CRB check is to have a new 1 issued with each post you hold. and depending on the involvement of the post you hold as to the intensity of the check ... i believe there are 3 levels of checking ... the lower 1 and free is for volunteers and the next up is for teachers etc with the upper 1 being for social workers etc.. dont know for sure tho.
well i think this hole crb check is proved not to be perfect in the light of the peado in a nursery!
the world has finally gone bonkers!!
all clarified now by the government....as with most of these things, people taking it all out of context. It has been stated that family or freinds can look after each others children, without a problem. Unless the payment(reward) is high enough to be taxable, then there is no need for anyone to be checked. The two ladies in this case have been told to carry on with their arrangement, without any cause for concern. As with so many of these things....someone somewhere trying to make more of it, than was the case. remember when we were told all bananas had to be straight.....and prawn cocktail crisps were to be banned !!
all pretty much as I said earlier in this thread !!!
i have just looked on the ofsted site and as far as i can see then the 2 women do need to register with ofsted and have a crb check
the only reason they wouldnt have to do this is if they were related or it was for less than 2 hours
this rule/law has been around for a very long time
i took this from the ofsted site
...
A childminder provides care for children to whom they are not related and of any age up to their 18th birthday on domestic premises for reward. Domestic premises mean any premises which are wholly or mainly used as a private dwelling, that is they are someone’s home. It does not have to be the childminder’s home but cannot normally be the home of any of the children for whom the childminder is providing care. People who look after children for one or two sets of parents, wholly or mainly in the home of either or both sets of parents, are not childminders but home childcarers. Reward can be money or payment by other means, such as gifts or services.
Childminders may work with up to two other people either as co-childminders or assistants. If the number of adults caring for the children exceeds three, people must register as a childcare provider on domestic premises and meet the additional requirements for childcare.
Childminders must apply for registration if they intend to provide care for one or more children aged from birth to eight years where at least one individual child attends for a total of more than two hours. They cannot provide care before they receive their certificate.
thanks for the link Fabio.....was all over the news today... no checks required as long as no financial gain, deemed as taxable.
so the govement is going to change the law (childrens act)
probably does need renewing but i must admit i find it odd that its being altered now when its been fine till now !
maybe thats because its 2 police officers who have challenged it ? dunno just a thought !
certainly wasnt altered for normal people who have challenged it for many years when they have been told they have to register etc
i personally think that particular part of it is good tho, i think people should register and have crb checks when they are looking after other peoples children !
its safeguarding children
its not changeing law......its just clarified what the word...REWARD means. When freinds were looking after next doors kids for an hour after school, and then you did same next week, some were saying that was reward !! I think you will find this was simply an over zealous person, takeing things to extreme. So it has been clarified, that yes freinds can run each others kids, to school football practise; yes freinds can have arrangements to pick each other kids up from school, etc etc..... However if you doing activity that means you make money..ie Child Minding for a living or swimming lessons down local school, ..then yes you will stil need a check.
Basically a common sence appraoch to what the word reward means.
Thats the way law works innit.
You write a staute, the courts interpret it, if it needs clarifying you can wait for the courts to reinterpet it or you can clarify it by statute. Im glad they have taken the decision to do so.
This is the kind of madness this act has started.
The next thing is you will not be able to talk to somebody elses child unless you have been " checked ".
It will get to the stage where IF a child needed help from an adult in a serious situation, the adult will not want to get involved.
The PC brigade out there will certainly never find themselves out of work, as everyday a new mad rule is brought in.
Instead of the Posties striking, I think these nutters should go on a permanent holiday.....to la la land!
You are aware, I assume, that parents arent even allowed to wander around the schools their children attend unsupervised.
Its political correctability gawn mad i tells ya.
It looks like now you aren't even allowed to look after your own kids without a CRB check -- Watford council have banned all parents who do not carry a CRB certificate with them from entering the council's play areas to look after their own children !!!
How long will it be before they take them off you at birth unless you are a "certified" parent????
