The CICA have confirmed it is absolutely nothing to do with the litter fine. Yes, he's had a clean record for 20 years, however he had a conviction prior to that of more than 30 months imprisonment, which was taken into consideration when making the award. Imprisonment over 30 months is never classed as a spent conviction.
