Thank you all who have added to this thread, especially to Butters for your advice. I've asked for a copy of the schools behaviour and discipline policy and will collect it this afternoon. But after this mornings phone conversation with the Head Mistress I think a good lawyer is what I need.
UPDATE
My son and 9 other children have been enrolled into a *teaching children how to play* programme at the school.
This is a situation I cannot accept nor am I willing to walk away from it.

Who has enroled them into this programme ??
if it is the school and it is after hours then you have no obligation to allow your child to attend...
If it is during school hours then you need to ask why other children are not being given the benefit of this invaluable teching(removes tongue from cheek)..
I would be having stern words with the head and asking for an appointment with the school goveners and if you get no joy there go to the LEA....
Get hold of the Chair of School Governers and one of the Parent Governers and get then involved and find out when this programme was brought in etc. If they cant help get hold of the LEA Governers and make them aware.
In fact let as many parents know as possible and get feedback
Good Luck hun

Libra this is crazy crazy crazy - and furthermore its crazy.
I mean he KISSED her, thats all - and 5 year old kisses are usually pretty transitory affairs aren't they?
What are these people on?How did THEY conduct themselves at that age - or were they PERFECT!!!!!?????!!!!!

Call me , but it sounds like they have a new class "teaching children how to play" and nobody to fill it, so they are picking on the wee ones to justify running this class, in a year or so someone will use the "bums on seats" figures to prove it is a success.
My god they will be jumping on the boys if they shake the dribbles from their willies too much when they go to the toilet.
No surprise we're breeding a nation of young men who see women as nothing but sex-toys, if this is the lesson they're learning as kids... kissing a girl is Sexual Harassment. Sexual Harassment is wrong and demeaning to women. Therefore, if a girl lets you kiss her, it's wrong and she wants to be demeaned by you.

Ask to be given a copy of the schools behaviour and discipline policy with regards to pupils and see what is mentioned in there. If nothing is mentioned in the policy regarding this type of behaviour ask them to review the policy and add something to cover this type of incident and make sure it's distributed to all parents, it is one of your rights as a parent to do this. It will cause hell for the teachers and head teacher and will soon make them rethink their stand on the issue, it will take at least 3 months of hard work for them to comply with your request, if they want to be shity then you can be shity back!
By the way I’m a chair of governors a vice chair of governors and a parent governor and I know how much the school will hate it!!!!! wink

And with the new freedom of information act due to come in shortly, from my understanding you will be legally entitled to a response in 28days
then again after re reading what i wrote i think its something like 48 days, forget about any of what i just said. i really have no clue what im on about today. to much work to do....la la la la

That's not correct, unfortunately, parents are legally obligated to comply with disciplinary detention for their children, including at weekends, in the absence of reasonable excuse. Nor is the assertion made above that schools have no mandate of discipline to 5 year olds accurate.
*It's not eloquent, but it works ;)
I think it needs to be taken into consideration the mental state of the person who viewed this kiss from one 5 yr old to another as wrong?!? does that make sense.. all I'm trying to say is that to view something this innocent as wrong.. they must have some pretty warped views. (in my opinion anyway)

With disciplinary detentions yes but these extra classes are not disciplinary detentions they are purely a way for the school to promote a certain level of behaviour during play which the parent has every right to refuse to allow their child to attend unless they are being given under the heading of Special needs in which case a parent has the right to see the special needs assessment of their child and the right to obtain an independent assessment and take it before the L.E.A
