They didn't hack the SH systems. They got in through the front door, like everyone else, because its a free site.

It is not a 'free' site in that anyone can use it, there is simply no monetary cost. To contact people you have to be a member, to be a member you agree to the rules. Break those and you are not using it with Marks permission. Without his permission you are in essence abusing the site, using it for somthing other than it is intended for, so hacking...
Never stand up in court, but in principle...

They couldn't join a fee paying site as it would show up on the company good for business. So this point was considered.
My guess is that they got the ex con to play out the part, probably by talking the whole thing over in a pub somewhere.
it is manufactured reality.
